Terms and Conditions
Welcome to our terms and conditions (“Terms”) for Samurai Museum Shop. Please note that your use of our website is governed by the following Terms. These Terms are between you and Samurai Museum and govern our respective rights and obligations. If you use our website, you accept these Terms.

Warning
The purchaser holds accountable for complying with all applicable laws and regulations, which may vary in each country.
You must be at least 18 years of age or older to purchase at Samurai Museum Shop. No Person under the age of 18 may order products. It is impossible for us to prohibit minors from visiting or making a purchase at Samurai Museum Shop.  Therefore it is his or her guardians that shall supervise children who are under 18 years of age for them not to visit or purchase at our website.
Samurai Gift Shop is not responsible if one harms others or hurts oneself by misusing items he or she purchased on the website. We also deal with original edged samurai swords, which might be dangerous, even deadly, if wrongly used.

Products
We sell products that are guaranteed to be in excellent condition and meet our high standards. We deal with the variety of items such as Samurai armor, replica/antique Samurai swords, sword decorations, and antique items.

Return and Exchange Policy
At Samurai Museum Shop, our goal is to make sure you are satisfied with your purchase and the service we provide. If you wish to return or exchange your purchase, please send us an email to order@samuraimuseum.jp.

We only accept returns/exchanges when you receive
1) products with manufactured defects.
2) incorrect products.
Please notify us within 72 hours of your order reaching your shipping address.

Your return package must include a copy of the invoice showing the item you wish to return. Samurai Museum Shop will then check the returned item within three business days after the package arrival.

We will send a new product to your billing address or initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your credit card issuer’s policies.
*You will be responsible for paying for your shipping costs for returning your item. Shipping costs are nonrefundable.

When you like to return/exchange the item for the reasons above, we strongly recommend that you use a shipping service that provides a tracking number. Please send the tracking number of your returning item via email. We will NOT be able to issue a refund or exchange an article until it is successfully delivered.

*Please send us an email FIRST regarding the damaged item or a wrong item you received before you return the item to our address; otherwise we cannot assist you.
* Real samurai swords, sword decoration or antique items might have some scratches, but those are not considered manufactured defects.
*If your improper use of the item causes the damage, we cannot accept the refund or exchange the item for a new one.

Shipment and Delivery
We offer you Free Shipping worldwide as long as we can ship your order by EMS.
*We might use other shipping carriers instead when we can’t deliver an item by EMS. In that case, depending on countries, we will have to charge an additional shipping fee.

1, General Delivery Time
It takes approximately 5-14 days to deliver after placing an order if you live abroad.

The time of delivery is estimated as accurately as possible by the carriers but does not take into account any delays beyond our control, such as inclement weather, holiday seasons.

2, Authentic Japanese Sword
To legally ship an authentic Japanese sword from Japan to another country, we will have to apply for its export permit to the Agency for Cultural Affairs(Bunkacho). We also must return the original registration paper to the Board of Education. It usually takes around 2-4 weeks to receive this permit after submitting the required documents. And we would like you to expect at least 1-1.5 months for your order to arrive at your given address after you ordered. For more detailed info, please click here.

 We have shipped authentic Japanese swords to the USA, UK,Canada, Mexico, Germany, Switzerland, France, Czech Republic, Hong Kong and Australia. If you don’t live in these countries and like to order, please contact us first before purchasing. We normally ship by EMS (Express Mail Service) provided by Japan Post. When we receive an order from Canada, Germany, Switzerland and Czech Republic, we will use FedEx instead of EMS.

 It is allowed for residents in Japan to own authentic Japanese swords without a special license as long as they come with registration papers. Please feel free to contact us if you are a resident of Japan, whether temporarily or permanently. We will also assist you when you leave Japan and need to obtain an export permit. 3, Replica Japanese Swords
We send out replica swords to USA, Canada, France and Switzerland. If you don’t live in these countries and would like to order a replica Japanese sword, please contact us prior to your purchase.

 Please keep in mind that we can’t ship replica Japanese swords to specific countries due to the effect of COVID-19 for the time being. If you purchase a replica Japanese sword without contacting us and we will have to cancel the transaction because EMS shipping isn’t available to your country, we will refund the money but charge the handling fee.

4, Antique Items
We ship antique items including sword mounting, Samurai armor and other Japanese artifacts via EMS and DHL (Canada only).

5, Marutake Samurai Armor
We also deal with hand-crafted Samurai armor made by Marutake. It is available on request and it will normally take about 3-4 months for Marutake to produce one armor. They will send the armor to your address directly from Kagoshima, their headquarter.

*Depending on the model, it might take more than 4 months. If you like to know an approximate delivery time, please contact us before you make a purchase.

6, Shipping Carrier
We ship your package by EMS(Express Mail Service).
 We have full confidence in the shipping company. We have been using their service for a long time but haven’t had serious problems. You can check where your package is by using a tracking number we provide.

 Due to the spread of COVID-19, EMS temporarily has halted the shipment between Japan and Australia, Canada. Therefore, we have been using other shipping carriers(DHL, FedEx) to ship orders to those countries. If you like to know the detail, please feel free to contact us.

7, Caution
 Samurai Museum Shop is not responsible for any lost package that is incorrectly addressed due to customer error.
We make our shipping labels based on the information a customer provides. If you accidentally enter an incorrect or incomplete address and you are bound to inform us immediately (within 24 hours of your order).

 In case your package is shipped back to our address because of your extended absence from the home, you must pay a reshipping fee for delivery.

  If you haven’t received your order even after the expected delivery time, please check with your local post office or DHL/UPS/FedEx. Please keep in mind that more time would be needed when you order authentic Japanese swords/Samurai armor.

Customs Duty
 International orders may cause duty fees on arrival in your country. Any customs fees for items are your responsibility. Importing certain items might be restricted, depending on countries. We could answer whether we have shipped items to your country before if asked.

 We will not be responsible if the custom seizes the item you purchased. You are the one to make sure that your purchased item is allowed to be imported into your country.

Payment Method
The purchaser can choose currency among Yen, USD, AUD, GBP, EUR to make a purchase on our website.
All orders must be paid beforehand. Payment methods accepted are as below.

-Stripe(Credit Card Payment: Visa, Mastercard, JCB, American Express)
-International Bank Transfer *if requested

Typographical Errors
In the case that a Samurai Museum Shop accidentally list products at an incorrect price for system errors or other reasons, we hold the right to cancel your orders. We reserve the right to refuse or cancel any such orders whether or not the order has been completed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Samurai Museum Shop will issue credit/refund for the amount charged.

Registration
You can make your account on our website so that you will be able to facilitate the financial transaction next time you purchase through our website. ( You can purchase in the absence of an account.) Your personal information is protected at our site. You hold responsible for securing your account and password. If you are suspicious of your account being hacked, please notify us immediately so that we can stop the transaction.

Feedback
All comments, feedback, suggestions, ideas offered by customers shall remain Samurai Gift Shop’s properties.
Please make sure that the language is appropriate when posting comments. Reviews with abuse or obscene contents will be removed and blocked from our website.

Privacy Policy

We are the only one that collects the information on this site. We only have access to information that you give us voluntarily via our order form or email. Our sole purpose to use your personal information is to provide you our service. We will not sell or rent this information to anyone. We have no intention to share your information with any third parties other than accomplishing your requests, such as giving your name, shipping address and email to our shipping carrier (EMS) .

We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that user activity violates other’s rights, or protect anyone’s rights, property, or safety. We may also share  information with service providers who help with our business operations such as credit card processing.(Paypal/Stripe)
We delete personal information when we no longer need it for the purposes described above. We retain personal information as permitted by law to resolve disputes and enforce our policies. To access or correct your information, please contact us via email.

We pay careful attention to protect your personal information against unauthorized access and disclosure, but we do not guarantee, and you should not expect, that your personal information will remain private such as in the case of your computer being hacked. We are not responsible for any privacy policies or data practices of any other third party websites, including without limitation of any social networking website or service.

Orders
Placing your order with Samurai Gift Shop contains an offer, which we reserve the right to approve or reject at our discretion. No contract will ensue until Samurai Gift Shop has accepted your offer by validating your order. If your order is disproportionately large such as 100 replica swords, we may reject your request.

We ask information from you on our order form. To purchase from our website, you must fill out your contact information and financial information. This information is needed for billing purposes and for filling your orders. If we have difficulty in processing an order, we will use this information to reach you.

Security
We implement high safety measures to protect your information. When you provide sensitive information via the website or email, your information is protected. You agree that any and all disputes or claims that have arisen, or may occur, between you and Samurai Museum relating in any way to or arising out of these Terms. Your use of or access to Samurai Museum Shop, or any products or services sold, offered, or purchased through Samurai Museum Shop shall be resolved exclusively by final and binding arbitration, rather than in court.

Notification of Changes
Whenever we change or update our Terms and Condition or Privacy Policy, we will post changes and updates on our website for our customers. We recommend customers to check and review this Privacy Policy and Terms and Condition from time to time for your update.
